ПРАВОВІ ОСНОВИ МОНОПОЛЬНОГО СТАТУСУ АМЕРИКАНСЬКИХ СПОРТИВНИХ ЛІГ

У статті досліджується правова природа монопольного статусу американських професійних спортивних ліг, який бере початок від рішення Верховного суду США у справі Federal Baseball Club of Baltimore, Inc. v. National League of Professional Baseball Clubs (1922) [17]. Доведено, що антимонопольний імунітет Major League Baseball є унікальним правовим артефактом американської прецедентної системи, збереженого Верховним судом у справах Toolson v. New York Yankees (1953) та Flood v. Kuhn (1972) не з огляду на правову обґрунтованість, а внаслідок інституційної інерції та принципу «stare decisis». Аналізується процес легітимізації монополії через судові прецеденти та законодавчі акти, зокрема Sports Broadcasting Act (1961) та Curt Flood Act (1998). Особлива увага приділяється механізмам монопсонічного контролю над ринком праці спортсменів: показано, що система Reserve Clause (1879–1975) штучно знижувала зарплати гравців на 40–80% від їхньої ринкової вартості, а її скасування арбітром Пітером Зайцем у справі Messersmith/McNally (1975) призвело до більш ніж 100-кратного зростання середніх зарплат упродовж наступних п'яти десятиліть. На підставі порівняльного аналізу MLB, NFL, NBA та NHL встановлено парадоксальний результат: ліги без антимонопольного імунітету, що пройшли через конкуренцію з альтернативними лігами, виявились значно більш інноваційними та комерційно успішними, ніж захищена правовим статусом MLB. Критична оцінка монопольної моделі з позицій теорії добробуту споживача засвідчує, що її головним бенефіціаром є власники клубів, а не глядачі чи гравці. Окреслено перспективи адаптації захисних і регуляторних елементів американського досвіду для України з урахуванням євроінтеграційних зобов'язань та актуальної практики Суду ЄС.
